Contracts don't really mean anything or much. Its just that westerners seem to do them so they exist but they aren't a Chinese idea or concept. No, i cannot imagine any FT ever getting anywhere in terms of a lawsuit of any kind. I mean if that ever happened I'm genuinely shocked and surprised!
Unfortunately, this simply shows arrogance on behalf of the Chinese boss
Chinese bosses are very good at shouting 'It's in the contract' until such time as an FT needs to shout those words back at them
I joined my current school in Feb 2015 (halfway through the school year) and my contract CLEARLY STATES that airfare reimbursement will be made AT THE END OF THE SCHOOL YEAR
However, in Chinese it states AFTER COMPLETION OF ONE YEAR
Nowhere in the contract does it state that Chinese takes precedence over English - so the two paragraphs contradict each other
Did I get my airfare last June? hahahahahaha !
There's a huge sh*tfight going on right now due to an FT pulling-the-pin over a contractual issue. The SCHOOL is 100% at fault but of course, they blame the FT because it MUST be their fault - right?
I'll tell you guys more about it after the fight is over and a conclusion has been reached, but just remember.....contracts are worth NOTHING unless the school says so
I would LOVE to hear about ANY westerner who has taken an employer to court (in China) over a contractual issue and won !
You should never hope Chinese treat you the same as they would another Chinese because that means you are as valuable as your brand name items, address and will live in a 'shame culture' where 'honor' is found by degrading another around you (fight to the bottom).
But I get what you want to say. The problem is that people like Jia here are not able to understand what 'welcoming' or 'polite' or what actually is the proper way to treat fellow human beings.
Jia only knows this very common Chinese understanding: China is #1. Chinese are the most welcoming and friendly to foreigners. Western Countries hurt and kill foreigners, Black people and killed Chinese people.
"Therefore"....
He can conclude that you, asking to be treated better is arrogant! Are you a King?! He already knows you are treated better than anyone else on Earth yet you ask for MORE!? You already get the best respect, welcome and friendliness but you COMPLAIN MORE!?
Jia can't see outside that. He cannot compute any other way of seeing your requests. He simply can't understand what you are complaining about because he just knows you have nothing to complain about. That actually you ought to be GRATEFUL you are treated better than Westerners would treat you back at home!
I really began to understand this Chinese mentality when I tried to tell Chinese managers how to treat the foreign teachers they were hiring (or firing, or losing).
In fact, they could not 'compute' that they were being rude, unwelcoming, unhospitable!
It was a 'contradiction' because they already KNEW Chinese are 'very welcoming and friendly' therefore it was impossible to say otherwise. In fact, I must be just insulting them.
Okay, then why don't they just leave China?! (the standard Chinese answer to any criticism).
To be clear: MANY Chinese are very good and I also believe some things are innocent cultural differences (so nobody is intentionally rude) and to make Jia happy I will even agree some foreigners are asking for too much (or ask for others to accomodate their cultural needs).
But in this case, Jia cannot hear you. Cannot 'process' the information because... he knows without any doubt Chinese are the best so how can you contradict it???
btw a funny real life conversation I had with a school manager who decided they wont supply FTs with nearby apartments but WILL have them come in twice a day (4 hours between classes) and is very upset some have been late for work (which is akin to murdering people when FTs do it) and so something like this:
Me: Ok, so, you know traffic is insane in the city, your location is off the bus routes, the foreigners cannot read the bus system, signs, maps and moreso they don't really understand how things work (holiday time traffic jams, new construction, etc etc).
Chinese manager: Ya, they must be here on time.
Me: Right, okay but you wont locate them nearby and insist on giving them split shifts (twice daily) or 2 different locations each day so how can you help them?
Chinese Manager: Ya, its in the contract. I told you this is the contract they agreed to it.
Me: Sure, but we need to solve the problem so could you arrange a driver for them for example?
Manager: but its not in the contract. they signed the contract so they agreed. so they need to be here on time every time. in the contract.
Me: What if you just send them a PA with good english skills to show them how the bus works, write them the times, show them the routes, explain how they can do it faster, write the school address in Chinese and give them a taxi phone number?
Manager: They can do that if they want but they sign contract! (exhausted im so stupid I can't understand they signed contract FFS!)
Me: Okay, did you know that in America we actually were REQUIRED to take responsibility for the Chinese workers arriving on time at the correct locations. That means we (the supervisors) were held to account. IF they were late - I MYSELF would get a meeting with the boss asking why I knew the CHinese were obviously not going to know our buses/taxis/maps/traffic etc and why I wasn't helping them?
Manager: ya but this is China. This is China so you know they say 'When in Rome'. This China. They sign contract.
The manager genuinely believes she is 'clever' and 'smarter' and would proudly inform the owner she just learned she is saving money and China is the winner because obviously China doesn't have to do the thing American fools agreed to do. So China is better.
The bigger picture is: White men are not longer that important in China. This is the reason you and your buddies here keep complaining how local Chinese are not that nice to all of you anymore.
This isn't really true and its not really 'relevant' to the complaints being made.
'White men' [though I dont know its actually that specific but foreigners] are still important and I suppose they 'ought to be' if a country plans to keep connected to the outside world.
But White men don't really need to complain for themselves. They will return to their White Man homes and be happy and safe. But sometimes they will feel a little sad or even upset they: 1. weren't able to help China 2. will know that good Chinese are living with the consequences in China and that's really too bad.
This is confusing you know. This made no sense to you. So let me try and explain:
'White men' (not only them) but sometimes they actually feel upset, angry, disappointed, sad and complain about what bad things will happen to OTHER people including innocent good Chinese people!
Crazy talk! I mean that probably sounds so crazy you just have to reject what i've told you. Say 'it makes no sense' and go back to this hateful selfish idea you have been working on. It must be their own selfish losses.
I believe this is your fantasy and its very Chinese - the only way to see things is by 'who has more' and then hoping they lose it. This is 'justice' and this makes you feel stronger and better. Oh... you may be everything that is wrong.
You might be the very problem.
You are really 'what is wrong with China' and remember - it will be you and Chinese who pay the price for your ignorance
Once China is done with its childish nationalism and finally enters the 21st century to catch up with the rest of the world, you will realize that even though we look different on the outside, inside we are all the same.
I treat Chinese just like I would treat anyone back home, be they White or else, I do not have a condescending attitude, do not look down upon them, do not worship them either, I treat everyone the same as my equal.
As a Foreigner, I do not ask for a special treatment, be it good (privilege/worship) or bad (disdain/racism), I just want to be treated the same as Chinese treat each others, how is that too much asking? I never see Chinese staring at each others, they do not make rude comments in the face of other Chinese assuming they can't understand, they do not stare angrily at other Chinese men when those are hanging around with their girlfriend. Then why do they think it's okay to do these with Foreigners? If you make a rude comment in someone's face this person will call you out on it, be it a Chinese or a Foreigner. Increasingly more Foreigners speak and understand Mandarin, watch out.
I have hope for a growing number of Chinese now understand this, especially the more educated city folks, but they probably represent less than 5% of the whole, jia you China, educate your population the right way, all the same, not us VS them. The later will only create more anti-Chinese sentiment across the world resulting in hatred and violence for the Chinese, not what you want.
The reality is, many of your women still like big white d..ks, even if they don't really like us. Apart from a bit of sex, your women are mostly useless. Many are not even useful in bed. Deal with it!
That would suggest I am small-minded and cannot see the bigger picture
The bigger picture is: White men are not longer that important in China. This is the reason you and your buddies here keep complaining how local Chinese are not that nice to all of you anymore.
Another bigger picture: noone in China mainland want China to go back to the time before the revolution with lots of abusive foreigners around, of course some of them probably were ok. Please don't blame Mao or any Chinese leader, revolutions are not just one person making noise.
Best to you and thanks for all your good replies.
