Exactly. I'd love to see just how and where they intend to bring a libel case against anyone. Internet libel is a difficult thing to prove. It is up to the person making the claim that something is libelous to show why it is, which in the case of someone making false statements should be a pretty easy thing to do but not when said statements are true and especially so when in the case of Yuming, the person(s) have that little seemingly forgotten about thing called.......evidence.

Helen keeps making threats and saying "it does not tally with the fact" and using words like "Libelous". Perhaps she should actually consider the fact that people are not stupid, we don't go around making false accusations.

In my case, as no doubt in the case of anyone else who has had any negative statements to make about Yuming, I can prove what I say is the truth. I have my original contract as well as a copy of the one I was offered for a further 12 months, both with the red chop on them which clearly show the contradictions made in their advertisements. It shows the rate of payment and clearly shows there was no offer of an increased salary the following year, which amongst others is another reason I decided to leave.

I have never seen nor signed any documentation as far as a health insurance policy is concerned and therefore Yuming cannot produce evidence to show the contrary. As with most people I am sure, the only health related thing I took part in was the immigration health check that ALL foreign employees have to take on arrival. Hardly "a health insurance" as is stated by Yuming.

I have bank statements clearly showing when and how much I was paid during the contracted period which again show the unpaid periods during the Winter and Summer holidays. Additionally on my side I have all the papers issued during the 12 months which they drop in to the school telling you when and how long you will be on holiday for, emails sent from their email address to my inbox which in a couple mention holiday periods and in one actually discusses what work they can offer me during the Winter holiday, that being one forty minute class a week "maybe", something I bet Helen forgot about when she started threatening people :)

On top of all that there is the simple common knowledge which I learned later after being in China for a while that ALL schools have much longer holiday periods than is stated in their advertisements and additionally have examination periods around those times too, increasing the length of time an FT's services would not be required. Even my current school would be happy to submit information like that as I have a good relationship with them and as I say, that fact is common knowledge to the authorities and to anyone who has been here a while.

We all have the evidence online in the form of the trillions of advertisements they put up which contradict each other in what is offered as well as contradicting the statements made on their website which, despite their attempts to regularly reword certain areas still shows they are not outlining the exact situation. And further, even if it did so now, I had their website checked and copied, twice, down at the labor court offices in Tianjin by a professional government representative which means it can be submitted as evidence without being accused of tampering. I also submitted all manner of other evidence against them which was accepted. They for example copied the emails and took note of the IP which it was sent from. Took copies of my bank statements, contracts etc and Secretly videoed conversations which took place, you gotta love technology :P

I did a lot of this prior to discussing my intentions to leave Yuming as I found a website, cant remember which one now that had some rather disturbing details from an FT who had tried to leave a couple of years earlier. After reading his story I wanted to ensure my departure, if it was true of course, would not be so costly and/or difficult. Upon informing them of my decision they quickly became the people I had read about in his story and began messing me around.

At the time, my intention was simply to force them into giving me my release letter which they refused to do and hand over my FEC which they denied existed so I could change employers. I wanted to show what kind of people they were and that they were refusing to issue the release letter through nothing more than being vindictive. The only reason I did not proceed was due to the fact a court hearing would have taken quite a few months before being heard so as it turned out, it was a much quicker and easier process to go back home and start again with a new visa from the beginning. I was headed home for a holiday anyway at that time so thats what I did. However, the labor courts still have the file and evidence which is stamped with their chop and can be reopened at any time. thy told me that considering the kind of people they seemed to be it was worth keeping everything on record in case I had any other difficulties, who would have thought it could be put to such good use all this time after. It was pretty cheap to do too :P Glad I did it now.

If a fight is what the wonderful people at Yuming want then a fight is what they shall receive. Not that it would be much of one mind you but still, the outcome would please most I am sure. Then perhaps after doing so I can start a second case and sue them for the libelous statements they have made against myself of being a liar and therefore untrustworthy. After all when a company makes false statements like that against an individual the stress caused and damage to their character both professionally and non-professionally is significant indeed.......
