Response to postings online about KYP COLLEGE PAHANG, MALAYSIA.

Malaysia is a very good country and working here can be professionally fulfilling but as with any country, seek out a good employer and do your research before accepting a job.

When relocating to another country to work for an employer that same employer should know your work visa entitlement before offering you the job, the tax laws, the laws governing employing a foreign professional, the laws involving any other government department involved in allowing or denying the issuing of a work visa to a foreign national. Who you can turn to in that country for formal (often free) legal advice/support or representation.

I do not personally discourage any person from working in KYP College, Kuantan, it is a case of see and experience it to understand it.

Regarding postings here I still cannot comment regarding are they true or false, I can casually say, if I were a legal representative of the college I would have to face the situation as representing a defendant and proving through substantiation that the claimants claims are false.

I have requested and achieved representation from JPP Pahang, this is a legal government office which investigates and resolves industrial disputes between employees and employers. I have requested this office to talk to the college management. If the mediation receives a negative response, transfer the case to Kuala Lumpur for full action.

Considering the independent legal advice which I have also taken, I was told to take my case to the JPP industrial office as a starter and the advice also covered the methodologies for taking a second related further investigative legal action against an individual and not the college.

If you want to work in Malaysia in any of the various education sectors, they will have input into if you can have a work visa. For example if you want to be a lecturer in a college, they will produce a letter for the Malaysian visa office to agree or disagree your visa entitlement. This is done through identifying if you are properly qualified. Naturally, if they refuse to issue a support letter, you will be denied a visa, they keep records so if they note a follow up visa application from a prospective employer claiming you will do a different job, they are professionals and will respond legally and appropriately. Be on your guard, it is not unheard for an employer to achieve a visa for a different job title and then put an employee to work in duties which do not reflect the job title or the professional ability of the holder of the visa.If that happens your work contract will be illegal, your actions will be illegal and your legal rights zero. Do your research make sure you protect yourself and your employer, ensure that illegalities do not accidentally take place.

In most countries, students pay for education and rightfully expect that they are being taught by an appropriately qualified person, students and legislative authorities will not be happy if they are scammed. These same expectations are exercised by government offices in all countries. Such governments offices will take action if they are informed of any wrong doings.

Ensure you do not fall under point 6 in their list. This agency takes public feedback via phone and e mail and have strong investigative powers.

YOU ARE A FOREIGNER: We must obey and respect the laws in our host country, we must not work without the required work visa, if we break the laws we should expect to be reported and caught. If you have been refused a visa by a government and you continue to work on a visitor visa or participate in attempting to dupe the authorities with a different visa application, you can only blame yourself when you are caught. If you are working under one type of visa but knowingly doing different work/duties which are covered by a different visa it is illegal and you are disrespecting the laws in your host country. If an employer manipulates you into doing this, report the situation ASAP.

When entering most countries, do not forget to bring a police clearance letter from your home country, especially when working in schools or educational institutes. If your employer does not request such a document you need to get from them in writing an explanation as to why you are exempt?

Request a copy from the prospective employer of the visa requirements and qualifications which you must meet to obtain a work visa. Ensure you are being interviewed by actual human resources trained staff. Request a copy of the offered work contract before you enter another country, read it closely and compare the contract conditions against the employment laws in that country. Check the offered monthly pay against similar jobs. Ensure you are offered medical insurance for you as an individual and not a group insurance which will be controlled by one individual employer who will decide if you can get medical help, or not? Ensure any terms offered for housing are clear and not vague. Ensure your weekly/monthly working hours are stated clearly and avoid clauses such as "you will dedicate out of hours duties for the employer" as this is a scam to over work you and not pay overtime pay.
